TERMS AND CONDITIONS


These terms and conditions, which may be rectified from time to time, apply to all our services, directly or indirectly, (through distributors) made available online, by email or by telephone. By accessing, browsing and using our website and / or completing a reservation, you acknowledge and agree that you have read, understood and agreed to the terms and conditions set forth below (including the privacy statement).
Your content and infrastructure and the online accommodation booking service provided through this website are owned, operated and provided by Ao Rubro Advertising & Marketing Ldª and are made available for your personal, non-commercial use only, subject to the terms and conditions defined below.


0.DEFINITIONS
Sunholidays shall be construed as Ao Rubro Marketing & Publicidade Ldª, a limited liability company incorporated under Portuguese law, registered in Silves, Albufeira, Portugal.
"Platform" represents the Website where the Service is made available, owned, controlled, managed, maintained and / or hosted by Sunholidays.
"Service" represents the online booking service (including payment facilitation) of various products and services that are made available over time in our Platform.
"Provider" represents the hotel units, theme parks, attractions, excursions, boat trips, transportation services, and any other travel related products and services that are made available and available on our Platform.

1. SCOPE OF OUR SERVICE
Through the Platform, we Sunholidays and its partners provide an online platform through which our reservations products and services are advertised, through which visitors to the Platform can make such reservations. When making a reservation through Sunholidays, you will enter into a direct contractual relationship with the Provider with which you make the reservation or purchase the product or service. Upon booking, we act only as intermediaries between you and the Ombudsman, passing on the details of your reservation to the Ombudsman concerned and sending you a confirmation email on behalf of the Ombudsman.
By providing our services, the information we disclose is based on the information provided to us by the providers.
Our service is only available for personal and non-commercial use. Therefore, you are not permitted to sell, hyperlink, use, copy, monitor, display, download or reproduce any content or information, software, reservations, tickets, products or services available on our Platform for any commercial or competitive activity or purpose.

2. RATES AND BEST PRICE GUARANTEED
The prices on our Platform are highly competitive. All prices are per room for the complete stay, including VAT and all other taxes (such taxes are subject to change), unless otherwise stated in our Platform or in the confirmation email or ticket. Ticket prices are per person and are subject to the validity indicated on the ticket itself, if applicable. The applicable taxes and fees (including tourist or municipal tax) may be charged by the Ombudsman in case of no-show or cancellation. The accommodation may charge additional costs in case of no-show or cancellation charges.
There are sometimes cheaper fares available on our Platform for a specific stay, product or service, however, these established fares may entail special restrictions and conditions, for example, regarding cancellation and refund conditions. Please check carefully the product, service and the conditions of reservation and information before making your reservation.
Obvious errors and misconceptions (including printing errors) are not binding.
All special offers and promotions are marked as such.

3. PRIVACY AND COOKIES
Sunholidays respects your privacy. Please see our privacy statement and cookies for more information.

4. FREE
Our Service is free. Unlike many other companies, we will not charge you for the use of our Service or any other additional (booking) fees.
5. CREDIT CARD OR BANK TRANSFER
If applicable and available, there is the possibility of reservations being paid (totally or partially and as required by the conditions of payment of the accommodation) to Sunholidays during the booking process through secure online payment methods (provided provided by you). The payment is processed securely from your credit card or bank account to Portugal's bank account. Any payment facilitated in this way shall in each case constitute a payment of the reserve price per se of the product or relevant service in the final settlement corresponding to the due and total price and can not recover those amounts paid.
Sunholidays will provide Customer Service in the case of questions related to a reservation by credit card.
For certain rates or special offers (ie: non-refundable), please note that Providers may require that payment be made in advance by bank transfer (if available) or by credit card, and your credit card may be pre- authorized or charged (sometimes without any refund option) after booking. Please check the information (reservation) of your chosen product or service in detail to be aware of all the conditions before making your reservation.
In the event of fraud or unauthorized use of your credit card by a third party, most banks and credit card issuers cover all charges resulting from such fraud or misuse, which may sometimes be subject to a deductible ( usually in the amount of 50.00Eur (or the equivalent in your local currency) .In order to compensate you, make sure you report this fraud to your credit card provider (according to your rules and procedures) please inform us by e-mail (booking@sunholidays.pt, booking1@sunholidays.pt, booking2@sunholidays.pt) Please indicate "credit card fraud" as the subject of your email and provide us with proof of the deductible (ie: conditions of the credit card provider.) This indemnity is applicable only to reservations made with a credit card through the Sunholidays secure server and, when unauthorized use of the credit card does not result from an error on your part when using the server, but an error or negligence on our part.


6. PRE-PAYMENT, CANCELLATION, NON-COMPARISON AND CLAUSES
When making a reservation, you accept and agree to the relevant cancellation and no-show conditions and with any additional terms and conditions that may apply to your stay (available on our Platform). The general conditions of cancellation and non-appearance of each hotel unit are made available on our Platform, during the reservation process and in the confirmation email. Please note that certain rates or special offers can not be canceled or changed.
Please check carefully the room description before booking. In case of a cancellation or no-show, the tourist tax (if applicable) can still be charged. Please carefully check the (reservation) information of your chosen product or service to consult these conditions before making the reservation. Cancellation and prepayment policies vary by room type. Please read carefully the clauses and important information in your booking confirmation for additional conditions that may apply (for example, regarding age, security deposit, extra beds, free breakfast, pets). Late payment, invalid credit card data, or insufficient balance may result in no right to claim any (non-refundable) prepayment refund.
If you want to review, adjust or cancel your reservation, please check the confirmation email and follow the instructions accordingly. Please note that the accommodation may charge you for cancellation, pre-payment and no-show in the accommodation, according to the conditions in force in the accommodation; or you may not be entitled to any refund of prepaid amounts. We recommend that you carefully read the cancellation policy before making your reservation. Please note that you must make future payments due in time, as required by the reservation in question.
In case of late arrival or late arrival on the date of check-in or arrival the next day, be sure to inform the hotel in advance so that you know your arrival time and avoid cancellation of your room or the charge of a no-show . In case you need our customer service you can inform the hotel unit. Sunholidays is not responsible for the consequences related to its delay or any cancellation or no-show fees charged.

7. CORRESPONDENCE AND COMMUNICATION (ADDITIONAL)
When completing a reservation, you agree to receive an email that may be sent to you shortly before your arrival date, giving you.


8. CUSTOMER COMMENTS
The customer's comments may be inserted in the page of the unit in question in our Platform for the sole purpose of informing (future) clients of their opinion of the service and quality of the unit in question and may be (totally or partially) used and placed by Sunholidays at its sole discretion on our Platform. We reserve the right to adjust, refuse or remove comments at our discretion.

9. LEGAL NOTICE
Subject to the limitations set forth in these terms and conditions to the extent permitted by law, we will only be liable for direct damages actually incurred, paid or incurred by you due to an imputable failure of our obligations with respect to our services, up to a total value of overall cost of your reservation, as specified in the confirmation email.
However, and to the extent permitted by law, we shall not be liable for any punitive, special, indirect or consequential damages or losses, any loss, death, property damage, strikes, force majeure events or any other event that our control.
If Sunholidays charges your room, product, service, or has facilitated the payment of the value, you agree and accept that the hotel unit will always be responsible for the collection, retention, deduction and payment of taxes applicable in full to the relevant tax authorities.


10. INTELLECTUAL PROPERTY RIGHTS
Unless stated otherwise, the software required for our services, available for or used by our Platform, and the intellectual property rights (including copyrights) of the content, information and material on our Platform are property of Sunholidays.
Sunholidays owns all the rights, titles and interests in and (all intellectual property rights) (the design and the appearance (including the infrastructure)) of the Platform in which the service is made available and therefore does not you grant us no right to copy, alter, publish, promote, advertise, market, integrate, use, combine or otherwise use the content or our trademark without our express written permission. Any unlawful use of all the actions or behaviors mentioned above will constitute a material breach of our intellectual property rights (including rights in the database and copyright).


11. GENERAL PROVISIONS
To the extent permitted by law, these terms and conditions and the performance of our services must be governed by and construed in accordance with Portuguese law and any dispute arising out of these terms and general conditions of our services shall be exclusively submitted to the competent courts of Portugal.
The original Portuguese version of these terms and conditions may have been translated into other languages. The translated version is a courtesy and only an office translation, from which you can not take any rights. In the event of a dispute over the content or interpretation of these terms and conditions or inconsistency or discrepancy between the English version and any other language version of these terms and conditions, the English version shall prevail and shall be final within the limits permitted by law.
